The Law Firm of Timothy M. Ayres is one of Johnstown's leading and most respected law firms, with roots in the legal community dating to the 1800's. The Ayres' forefathers have been community leaders for over a century, including the City of Johnstown's first mayor, W. Horace Rose, and John M. Rose, 6-term U.S. Congressman. The firm’s history included John M. R. Ayres, his son, Timothy Marshall Ayres, and Linda Rovder Fleming, who joined the firm in 1992 and now serves as a Judge in Cambria County Court of Common Pleas.

With a qualified and professional support staff of 3 attorneys and 6 legal assistants, Ayres Law Firm completes legal cases in a prompt manner to the satisfaction of the client, who is kept fully informed of the status of the case throughout the process. The reasonable fees charged by our firm are discussed and approved by both client and attorney prior to any work being performed by the attorney on the client's case.

AREAS OF CONCENTRATION

Estate Planning:
Estate planning is simply the process of passing assets from one generation to the next with the least amount of taxes and administration expenses permissible under the law.  Our attorneys are prepared to handle your simple or complex estate plans to maximize the passing of assets between generations.  We are prepared to advise you on Last Wills and Testaments, Living Trusts, Irrevocable Life Insurance Trusts, and other more complex trust plans, Powers of Attorney and "Living Wills".  We have handled clients who have had simple estate plans, as well as clients who have amassed a great fortune to pass on to their loved ones or charitable beneficiaries. Attorney Chippie also handles grandparents' visitation rights.

Elder Law:
Elder Law is the general term for legal work associated with planning for the future, to save your hard-earned assets, to provide for future Medicaid and Public Assistance benefits for nursing home care in later years, and to financially provide for your surviving family so they are not left destitute by the high costs of nursing home care.  The topics will include the preparation of a Last Will and Testament, a Power of Attorney, possible Deed transfers of property to protect it for surviving family, and “Living Wills”.

Attorney Tim Ayres has been designated as a SuperLawyer® in the field of “Elder Law”, which is a special designation given to only 5% of Pennsylvania Lawyers.

Family Law:
Attorney Tonilyn M. Chippie handles family law, which includes divorce, equitable distribution of property, claims for spousal support and alimony, and child custody.  Our attorneys are well-prepared to deal with your questions regarding separation and divorce.  Competent legal representatives in these matters will help to make this difficult time less intimidating, by providing you with the knowledge and information you need to make informed, intelligent decisions.

Estate Administration:
Estate Administration is the process of opening a decedent's estate, administering those assets through the court system, and transferring ownership of the assets to the named beneficiaries under the decedent's Last Will and Testament or under the intestate laws of our Commonwealth.  Our attorneys are experienced in handling all types and values of estates and we pride ourselves in our efficiency, promptness, and reasonable fees for handling all of our clients' estate needs.

Social Security Disability:
Our firm has successfully represented hundreds of claimants in disability and Supplemental Security Income “S.S.I.” claims for over 30 years, and work with Clients in the process from start to finish.   There is never a fee for legal services unless you win your claim and are awarded cash benefits.

Adoption:

Our firm handles all types of adoptions, from the commencement of the process through the final adoption proceedings, for step-parents, the registration of a foreign adoption, or an adoption by private and unrelated parties.

Guardianships:
A guardian is one who has been appointed by the Court to act on behalf of an incapacitated person; and who has been given the power by the Court to make decisions concerning all aspects of the incapacitated person's life, including financial and health matters. Our attorneys are experienced in handling all matters of guardianships through the Orphans' Court.

Corporations/Partnership:
The firm handles a wide range of business organizations including the formation of limited liability companies, business corporations and partnerships and not-for-profit organizations.

Personal Injury:

Personal injury law addresses those cases in which our client has been injured due to the negligence of another party.  Most commonly, this includes injuries as a result of motor vehicle accidents.  This may also include other types of bodily injury, such as slips and falls.  Our attorneys have handled all types of personal injury cases on a "contingent fee" basis, which simply means that unless we get money for you by way of a settlement or a trial verdict, there is no fee for you.  This is especially important to those clients who do not have funds available to them, or who do not wish to expend out-of-pocket monies for the attorney to handle their personal injury case.

Real Estate Law:

Our firm handles real estate transactions for private real estate transfers among family, or the conveyance of property in a seller’s transaction.  Our attorneys are experienced and trained in all aspects of real estate law.

Civil Litigation:

If you become involved in a civil case where litigation may be necessary, our attorneys all have experience in handling these cases.  We try our best to reach a settlement of the claim without litigation, but we have the experience to handle civil trials or arbitration if necessary.

Unemployment Compensation Law:

Our attorneys have experience in handling unemployment compensation law, whether on behalf of the employer or the employee.  Cases such as these are usually settled at the local level in Johnstown.  However, on a few occasions an appeal is made to the Board of Review, and our attorneys have experience in handling both the initial hearing and appeal of unemployment compensation cases.
